1. Introduction and Agreement to Terms

Welcome to Passport to Life, a service operated by Career Coaching Plus, LLC,
a Virginia limited liability company (“Company,” “we,” “us,” or “our”), the legal owner
and operator of the Passport to Life website (https://www.passporttolife.org),
digital services, and online offerings. These Terms of Use (“Terms”) govern your
access to and use of our website, mobile or desktop applications, classes,
coaching programs, content, and any other services made available through
Passport to Life (collectively, the “Digital Services”).
By accessing, browsing, using, purchasing through, registering with, or interacting
with any portion of the Digital Services, you agree to be bound by these Terms of
Use and our Privacy Policy, which is incorporated herein by reference. If you do not
agree to these Terms or the Privacy Policy, you may not access or use the Digital
Services.
These Terms apply to all users of the Digital Services, including but not limited to
customers, subscribers, contributors, browsers, vendors, and merchants.
Your continued use of the Digital Services constitutes acceptance of any
modifications we may make to these Terms from time to time, subject to the update
process described below.

2. Eligibility and Account Registration

To use the Digital Services, you must be at least 21 years of age or the age of
majority in your jurisdiction, whichever is older. By using the Services, you
represent and warrant that you meet these eligibility requirements, that any
information you provide is truthful and accurate, and that you have the legal
capacity to enter into these Terms.
You may be required to create an account to access certain features of the Digital
Services, such as registering for coaching programs, subscribing to newsletters, or
participating in paid classes or digital events. When you register for an account,
you agree to:

  • Provide accurate, current, and complete information about yourself
  • Maintain and promptly update your information to keep it accurate
  • Keep your login credentials confidential
  • Accept responsibility for all activities that occur under your account

If you use a social networking service or third-party platform (such as Facebook or
X/Twitter) to access or register for our Services, you authorize us to collect the
necessary authentication and profile information from those platforms, subject to
their terms and your privacy settings.
We reserve the right to suspend or terminate your account at our sole discretion if
we believe you have violated these Terms or provided false information.

3. Changes to Terms

We reserve the right to update, modify, or replace any part of these Terms of Use at
any time to reflect changes in our business, legal obligations, or best practices.
When we make material changes, we will update the “Last Updated” date at the top
of this page and, where required by law, provide additional notice (such as by
posting a banner or sending an email if you are a registered user).
It is your responsibility to check this page periodically for changes. Your continued
use of the Digital Services following the posting of any changes constitutes your
acceptance of those changes. If you do not agree to the modified Terms, you
should stop using the Services and may request deactivation of your account.

4. Intellectual Property

a. Ownership of Content

All content and materials available through the Passport to Life Digital Services—including but not limited to videos, courses, coaching materials, articles, text, graphics, logos, button icons, audio clips, digital downloads, software, and trademarks (collectively, “Content”)—are the exclusive property of Career Coaching Plus, LLC or its licensors and are protected by U.S. and international intellectual property laws.
Passport to Life™, PassporttoLife.com, and related branding are proprietary marks and may not be used without our prior written consent.
 
b. License and Restrictions on Use
 
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content strictly for your personal, non-commercial use and subject to these Terms. Except as expressly authorized in writing by us, you may not:
  • Copy, reproduce, distribute, republish, upload, post, transmit, or publicly display Content in any form or by any means
  • Modify, create derivative works from, reverse engineer, or attempt to extract source code from any software associated with the
    Services
  • Sell, resell, lease, or sublicense access to any part of the Services
  • Use automated tools (e.g., bots or scrapers) to harvest content or data from the Service

Any unauthorized use of our intellectual property or breach of these
restrictions may result in termination of your rights and legal action.

c. User-Submitted Content and License Grant

By submitting any reviews, testimonials, feedback, comments, or other content (“User Content”) through the Digital Services or related platforms (e.g., social media, contests, surveys), you:

  • Represent that you own or have the right to share the User Content
  • Grant Passport to Life a royalty-free, worldwide, perpetual, irrevocable, and sublicensable license to use, reproduce,
    publish, modify, and display your User Content for business, marketing, educational, and legal purposes
  • Acknowledge that we may share your User Content on our website, social media, or in promotional materials

We reserve the right, but not the obligation, to moderate, edit, or remove User Content at our discretion.

5. Submissions and Reviews

a. Definition of Submissions

“Submissions” refer to any content voluntarily provided by you through our Digital Services or associated platforms, including but not limited to:
  • Testimonials
  • Reviews
  • Class or event feedback
  • Survey responses
  • Contest entries
  • Blog or social media comments
  • Photographs, videos, or artwork

These Submissions may be made through our website, via email, through third-party platforms (e.g., Instagram, Facebook, X), or at live Passport to Life events.


b. Rights Granted to Passport to Life


By submitting content to us, you grant Career Coaching Plus, LLC and its affiliates a royalty-free, worldwide, irrevocable, perpetual, and fully transferable license to:

  • Use, copy, modify, publish, display, distribute, and otherwise exploit your Submission
  • Use your name, likeness, and any associated biographical or identifying information, where provided or inferred
  • Share your Submission on our website, social media channels, and promotional or educational materials

This license applies regardless of the platform or medium through which the Submission is received.

c. No Obligation to Post or Respond

We are not obligated to post, host, publish, or respond to any Submission. Submissions do not reflect our opinions, and we assume no responsibility for their content, accuracy, legality, or appropriateness. If we post your content, we may but are not required to give credit or attribution.


d. Moderation and Takedown Rights


We reserve the right to review, screen, edit, reject, or remove any Submissions at our sole discretion and without notice. Grounds for removal may include—but are not limited to—content that:

  • Is abusive, defamatory, obscene, or offensive
  • Violates any law, regulation, or third-party right
  • Contains promotional or spam-like material
  • Poses a threat to the integrity or security of the Digital Services

If you believe any posted Submission violates your rights or these Terms, please contact us through the “Contact Us” section.

6. Payments, Orders, and Refunds

a. Order Acceptance and Processing
All orders placed through the Digital Services are subject to acceptance by Passport to Life. We reserve the right to refuse or cancel any order at any time for reasons including but not limited to:

  • Limitations on quantities available
  • Inaccuracies or errors in product or pricing information
  • Payment or billing issues
  • Suspected fraud or violation of these Terms

Upon acceptance of your order, you will receive an email confirmation. This confirmation does not signify final acceptance—only that we have received your request.

b. Payments

We accept payments through third-party payment processors such as PayPal and Apple Pay. By submitting payment information, you represent that you are authorized to use the payment method provided and authorize us to charge the total order amount.

We do not store full credit card or debit card numbers on our servers. Your payment is subject to the terms, conditions, and privacy policies of the respective payment processor.

c. Shipping and Risk of Loss

For physical products (if offered), delivery times are estimates and may vary. Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for delays, loss, or damages during shipment caused by carriers or third parties.

For digital products (e.g., courses, events, subscriptions), access is typically granted upon successful payment. If you experience technical issues, you may contact customer support for assistance.

d. Refunds and Returns

  • Unless otherwise stated on a specific product or event page:
  • Digital Services (e.g., courses, coaching, downloads): All sales are final. Refunds may be granted at our sole discretion in cases of
    service failure or technical error.
  • Live events or classes: May be refundable in part if cancellation occurs within the timeframe indicated at purchase.
  • Merchandise (if offered): Refunds or exchanges are subject to return policy terms posted at the time of purchase.

To request a refund, please email us at support@passporttolife.com with proof of purchase and reason for the request.

e. Fraud Prevention

We reserve the right to refuse any order suspected of being fraudulent or in violation of these Terms. If necessary, we may contact your payment provider or law enforcement authorities.

7. Disclaimer of Warranties

The Digital Services, including all content, products, classes, events, and tools made available through Passport to Life, are provided on an “as is” and “as available” basis, without warranties of any kind—express, implied, statutory, or otherwise.

To the fullest extent permitted by law, we disclaim all warranties, including but not
limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranties regarding accuracy, reliability, completeness, timeliness, or error-free operation
  • Warranties that access to the Services will be uninterrupted, secure, or free from viruses or harmful code

You acknowledge and agree that:

  • Any content downloaded or otherwise obtained through the Digital Services is done at your own risk
  • We do not guarantee the outcomes of using our coaching tools, self- help content, assessments, or any third-party integrations
  • Any reliance on materials, advice, or coaching from Passport to Life is at your own discretion and risk

8. Third-Party Services

Passport to Life may include links or access to third-party websites, tools, applications, or services (e.g., Shopify, Printful, Facebook, Klaviyo, PayPal). These third parties are not controlled by us, and we are not responsible for their
practices, performance, or availability.

Use of third-party platforms is governed by their own terms and privacy policies.
We do not warrant or guarantee the services of any third-party provider, even if
integrated with our Services.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Career Coaching Plus, LLC (d/b/a “Passport to Life”), its officers, directors, employees, affiliates, contractors, licensors, and service providers shall not be liable for any:
 
  • Indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation, damages for loss of profits,
    goodwill, use, data, or other intangible losses
  • Arising out of or relating to your use of, or inability to use, the Digital Services; unauthorized access to or alteration of your transmissions or data; conduct of any third party on the Services; or any other matter
    relating to the Services

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis—even if we have been advised of the possibility of such damages.
 
Cap on Liability
 
In no event shall our total liability to you for all claims arising out of or related to the use of the Services exceed the greater of:

  • The total amount paid by you to us in the six (6) months preceding the claim; or
  • One hundred U.S. dollars (USD $100)
 

Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Career Coaching Plus, LLC (doing business as Passport to Life), its affiliates, officers, directors, employees, contractors, service providers, licensors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
 
  • Your use or misuse of the Digital Services
  • Your violation of these Terms or any applicable law or regulation
  • Your infringement or misappropriation of the intellectual property or other rights of any person or entity
  • Any content, data, or materials you submit or upload, including customer reviews, comments, or third-party information shared without authorization
  • Any unauthorized use of your account, including by third parties to whom you have granted access
 
We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with us in asserting any available defenses.

11. Arbitration and Dispute Resolution

a. Informal Dispute Resolution

Before initiating any formal dispute proceeding, you agree to first contact us at legal@passporttolife.com and provide a brief written description of the dispute and your contact information. You and Passport to Life agree to use good-faith efforts to resolve the dispute informally within thirty (30) days.

b. Binding Arbitration Agreement

If the dispute is not resolved through informal negotiation, you and Passport to Life agree to submit any claim, dispute, or controversy arising out of or relating to these Terms or the use of the Digital Services to final and binding arbitration, rather than in court. The arbitration shall be conducted by the American Arbitration Association (AAA) in accordance with its
Consumer Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

The arbitration shall be held in Virginia, unless otherwise mutually agreed. The proceedings may be conducted by telephone, videoconference, or online to the extent permitted by the rules of the AAA.

c. Class Action and Jury Trial Waiver

You and Passport to Life agree that any dispute resolution proceeding shall be conducted only on an individual basis, and not in a class, consolidated, or representative action. You waive any right to a jury trial or to participate
in a class action or class arbitration.

If any part of this section is found to be unenforceable, then that portion shall be severed and the remainder of the arbitration agreement shall remain in effect.

d. Governing Law and Jurisdiction

These Terms and any dispute arising under them shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Subject to the arbitration agreement above, any legal action shall be filed exclusively in the state or federal courts located in Virginia.

12. International Users and Data Transfers

Passport to Life is operated by Career Coaching Plus, LLC in the United States. If you access the Digital Services from outside the United States, you acknowledge and agree that your information—including personal data—may be transferred to,
processed, and stored in the United States or other jurisdictions where privacy laws may not offer the same level of protection as those in your country of residence.

We take appropriate measures to ensure that any such transfers comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) for users in the European Economic Area (EEA) and the UK.

a. Lawful Transfer Mechanisms
 
Where required, we rely on one or more of the following legal mechanisms for international data transfers:
 
  • Your explicit consent to the transfer
  • Standard Contractual Clauses (SCCs) approved by the European Commission
  • Processing necessary for the performance of a contract with you
  • Our legitimate interests, balanced against your rights and freedoms

b. Responsibility for Compliance

If you are accessing the Services from a jurisdiction with laws or regulations governing personal data collection, use, and disclosure
that differ from U.S. laws, you are responsible for compliance with any such local laws. Your continued use of the Services represents your consent to the transfer and processing of your personal information as described in our Privacy Policy.

13. Third-Party Links and Services

The Digital Services may contain links to, or integrate with, third-party websites, platforms, tools, or services that are not owned or controlled by Passport to Life.These may include payment processors, email platforms, embedded videos, referral tools, advertising partners, social media widgets, or fulfillment services (e.g., Shopify, Klaviyo, PayPal, Facebook, X/Twitter, Printful, Return Magic).
 
a. Disclaimer of Responsibility

We are not responsible for the content, policies, terms, or practices of any third-party services or platforms. When you click a third-party link or use an integrated service, you are interacting directly with that third party and not with Passport to Life. Your use of such services is governed solely by their terms and privacy policies.

You agree that we are not liable for any damage or loss caused by or in connection with your use of, or reliance on, any third-party site or service.

b. Embedded Content and Cookies
 
Our website may include embedded content (e.g., YouTube videos, Instagram posts, embedded social feeds) that behave in the same way as if the user visited the third-party site directly. These third-party providers may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that content.
 
We encourage you to review the privacy and cookie policies of all third-party
services before interacting with them through our platform.

14. Termination of Access and Accounts

a. Grounds for Termination

We reserve the right, at our sole discretion, to suspend or terminate your account, access to the Digital Services, or any part thereof,
without notice, if we believe that:
 
  • You have violated these Terms or applicable law
  • You have submitted false, misleading, or unauthorized content
    or payment
  • Your conduct may harm Passport to Life, its users, or partners
  • Your use disrupts or otherwise interferes with the normal
    operation of the Services

We may also suspend access temporarily for maintenance, technical
updates, or security reasons.

 

b. Effects of Termination 

Upon termination: 

  • Your right to access and use the Services will immediately cease
  • Any rights granted under these Terms will terminate
  • We may retain or delete your user-submitted content, communications, or purchase history, subject to our Privacy
    Policy and applicable law 

We are not liable for any damages resulting from account or service termination.

 
c. Retention and Deletion Rights
 
We retain the right to preserve transaction data, correspondence, or content for audit, tax, legal compliance, or legitimate business
purposes, even after your account is closed or deleted. Certain data (e.g., payment confirmations, ticket purchases, gift orders) may be
retained for a minimum period required by law or internal policies.

If you wish to request deletion of your account or data, please email privacy@passporttolife.com. Such requests will be processed in accordance with our Privacy Policy.

15. Retention and Data Management

We retain personal data and related user content for as long as reasonably necessary to fulfill the purposes outlined in our Privacy Policy, including for:
 
  • The delivery of purchased goods or services
  • Ongoing subscription management
  • Customer support
  • Legal, regulatory, tax, accounting, and audit obligations
  • Business continuity and fraud prevention

a. General Retention Periods

We typically retain customer records, order histories, and account-related information for at least seven (7) years, or longer if required by law. Communications, submissions, and customer service interactions may be retained for internal training, dispute resolution, or business analytics.

b. Criteria for Deletion or Archiving

We will securely delete or anonymize personal information when it is no longer needed for legal or operational reasons, unless you have requested its deletion sooner (subject to legal exceptions).

Examples of data we may delete or archive include:

  • Inactive accounts beyond a specified retention threshold
  • Content voluntarily removed by the user
  • Obsolete survey or promotional data
  • Support requests older than the statutory recordkeeping period
 
If you submit a deletion or correction request under applicable privacy laws (e.g., GDPR, CPRA), we will respond in accordance with the timelines and procedures set forth in our Privacy Policy.

16. DMCA Notice (Copyright Claims)

If you believe that any content made available on or through the Digital Services infringes your copyright, you may submit a written notification pursuant to the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512(c), by providing our
designated agent with the following information in writing:

a. Required Elements for a Valid DMCA Notice:

1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner
2. Identification of the copyrighted work claimed to have been infringed, or—if multiple copyrighted works are covered by a single notification—a representative list of such works
3. Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate the material on the
Services
4. Your contact information (address, telephone number, and email address)
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

17. General Terms

a. Interpretation and Construction

Headings are for convenience only and do not affect interpretation.Wherever the words “including,” “includes,” or “such as” appear, they shall be deemed to be followed by the phrase “without limitation.” These Terms shall be construed fairly and not strictly for or against either party, regardless of authorship.

b. Entire Agreement

These Terms of Use, together with our Privacy Policy and any additional legal notices or service-specific terms presented to you, constitute the entire agreement between you and Career Coaching Plus, LLC with respect to the Services and supersede all prior or contemporaneous communications and proposals, whether oral, written, or electronic.

c. No Third-Party Beneficiaries

These Terms are intended solely for the benefit of you and Passport to Life. Nothing in these Terms shall be interpreted to confer any rights or remedies to third parties.

d. Waiver and Severability

Our failure to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision. If any provision is found to be unlawful, void, or unenforceable, that provision shall be severed, and the
remaining provisions will remain in full force and effect.

e. One-Year Limitation on Claims

You agree that any cause of action or claim you may have arising out of or related to these Terms or the use of the Digital Services must be brought within one (1) year after the cause of action arises, or such claim shall be
permanently barred, unless prohibited by applicable law.

18. Final Acknowledgment

By accessing or using the Digital Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. These Terms, together with any other legal notices published by Passport to Life, constitute the entire agreement between you and us with respect to the use of our services.

If any provision of these Terms is held to be unlawful, void, or unenforceable for any reason, then that provision shall be deemed
severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
